Clear terms. Fair access. Responsible use.
These Terms explain the basis on which you may use the National Attendance Portal, Attendance Magazine, our membership services, digital resources and interactive tools.
The important points first
We want these Terms to be understandable. In summary:
Access to Attendance Magazine does not require a paid membership unless a particular additional service is expressly described otherwise.
Paid resources are licensed for use by the person or organisation covered by the membership purchased.
They do not replace professional judgement, statutory guidance, safeguarding procedures or specialist legal, medical or clinical advice.
Do not enter identifiable child, safeguarding, health or case-record information into general Portal tools unless the tool expressly says it is designed for that purpose.
Nothing in these Terms removes rights that cannot lawfully be excluded under UK consumer law.
Membership resources may be used within the scope of your licence but must not be resold, publicly uploaded or shared outside that scope.
Important information about price, membership duration, renewal arrangements and what a membership includes will also be shown on the relevant membership or checkout page.
1. About these Terms
The National Attendance Portal and Attendance Magazine are trading names of SENDsational Education Ltd, a company registered in England and Wales under company number 15833753.
Our registered office is: 71–75 Shelton Street, Covent Garden, London WC2H 9JQ.
These Terms apply when you browse or use the National Attendance Portal, create an account, access free resources, purchase or use membership, download resources, or use our interactive tools.
If a particular service, event, consultancy engagement or product is supplied under separate specific terms, those terms may also apply.
Where specific information displayed at checkout or in an order confirmation describes the price, duration or content of your purchase, that specific information forms part of the agreement.
Nothing in these Terms affects legal rights that cannot lawfully be excluded or restricted.
2. The National Attendance Portal
The Portal brings together attendance information, professional learning, practical resources, research, commentary, downloadable materials, interactive tools and links to third-party resources.
Some content is available free of charge. Other content may require a current membership or separate purchase.
We may develop, improve, replace or retire individual resources as attendance practice, legislation, guidance, technology and professional evidence change.
Attendance Magazine is intended to remain free to access. Premium membership is not required simply to read the magazine.
3. Membership
Membership may provide access to Premium resources, professional-learning materials, downloadable tools, interactive resources and other benefits described on the relevant membership page.
What is included depends on the membership purchased. Please check the membership description carefully before purchasing.
Membership access is personal to the individual or licensed organisation covered by the purchase.
Login credentials must not be deliberately provided to people who are not entitled to use the relevant membership.
You are responsible for taking reasonable steps to keep account credentials secure and for notifying us if you believe an account has been compromised.
4. Schools, trusts and organisational memberships
Where a membership is purchased for a school, trust, college, local authority or other organisation, access may be used by authorised staff within the organisation to the extent described in the membership purchased.
An organisational licence does not automatically permit access by unrelated organisations, contractors, partner organisations or other bodies unless the membership description expressly includes them.
Internal use may include, where appropriate:
- using resources in internal staff development;
- printing materials for authorised internal use;
- editing resources expressly identified as editable for the organisation's own operational use;
- sharing relevant resources internally with authorised staff covered by the licence.
Unless we agree otherwise in writing, organisational membership does not permit:
- resale of Portal resources;
- public distribution of Premium materials;
- uploading Premium resources to a publicly accessible website;
- supplying Premium resources to organisations not covered by the membership;
- removing copyright, branding or ownership notices in order to represent our material as another person's original work.
5. Prices and payment
Current membership and product prices will be shown before you complete a purchase.
Any applicable taxes or other mandatory charges will be identified as required.
Payments may be processed by a third-party payment provider. We do not normally receive or retain your complete payment-card information.
A purchase is not complete until payment has been accepted or another agreed payment arrangement has been confirmed.
Organisations purchasing by invoice remain responsible for paying valid invoices in accordance with the payment terms stated on the invoice or separately agreed with us.
6. Membership duration and renewals
The duration of a membership will be shown when you purchase it or in the order confirmation.
A membership will only renew automatically where automatic renewal is expressly stated as part of the purchase.
Where automatic renewal applies, information about the renewal period, price or method for determining the price, and how to cancel should be made clear before purchase.
Nothing in these Terms creates an automatic renewal arrangement where one was not disclosed and agreed as part of the purchase.
7. Cancellations and refunds
Consumers
If you purchase as a consumer, you may have statutory cancellation rights for contracts entered into online or at a distance.
The precise right depends on what has been purchased and whether supply of a service or digital content has begun.
Where you expressly request immediate access to digital content or services during a statutory cancellation period, the law may affect the extent of your cancellation right, but only where the legal requirements for doing so have been met.
We will honour all cancellation, refund, repair, repeat performance, price reduction or other rights that apply under consumer law.
Organisations and business purchases
Purchases made wholly or mainly for business or organisational purposes do not necessarily carry the same cancellation rights as consumer purchases.
Any specific cancellation arrangement agreed for an organisational purchase will therefore apply alongside these Terms.

8. Acceptable use
You may use the Portal only for lawful purposes.
You must not knowingly:
- interfere with the operation, security or availability of the Portal;
- attempt to gain unauthorised access to accounts, systems or Premium content;
- introduce malicious software or harmful code;
- use automated methods to extract substantial quantities of Portal content without permission;
- systematically reproduce the Portal to create a competing content library or commercial service;
- use our resources fraudulently or in a way that infringes the rights of another person;
- deliberately submit unlawful, defamatory, threatening or harmful content;
- use another person's membership credentials without authority.
Nothing in this section is intended to prevent use that is expressly authorised by us or otherwise permitted by law.
9. Child, safeguarding and sensitive information
Unless a particular service expressly states that it is designed and authorised for this purpose, do not enter identifiable child information, safeguarding records, medical information, child-protection information, detailed social-care records or other highly sensitive case data into National Attendance Portal interactive tools.
The Portal is not a substitute for an organisation's MIS, safeguarding system, case-management system, clinical record or social-care recording system.
Schools, trusts, colleges, local authorities and other professional organisations remain responsible for their own compliance with data protection, safeguarding, confidentiality and record-management requirements.
Where a resource can be used anonymously, users should avoid entering names, dates of birth, addresses, pupil numbers or other unnecessary identifiers.

10. Intellectual property
Unless stated otherwise, intellectual-property rights in the National Attendance Portal, Attendance Magazine, original written content, branding, designs, frameworks, tools and resources belong to SENDsational Education Ltd or are used with permission from the relevant rights holder.
Membership gives you permission to use resources within the scope of the relevant licence. It does not transfer ownership of the intellectual property to you.
Resources marked as editable may be adapted for legitimate internal use within the scope of your licence.
You must not, without permission:
- resell our resources;
- publish Premium content publicly;
- reproduce substantial parts of the Portal as another resource library;
- remove ownership information in order to pass material off as your own original work;
- commercially license our material to a third party.
Nothing in these Terms is intended to prevent quotation, fair dealing or other use that is permitted by applicable copyright law.
11. External websites and third-party resources
One of the purposes of the Portal is to help users find useful attendance research, guidance, services and resources from other organisations.
Links to third-party websites do not mean that we control or endorse everything published on those sites.
External content can be changed, moved or withdrawn without notice to us.
Users should check the current version, publication date, geographical applicability and legal or statutory status of external guidance before relying upon it.
Third-party websites have their own privacy, accessibility, cookie and contractual arrangements.
12. Professional information and decision-making
The National Attendance Portal provides information, resources, professional-development material and tools intended to support better attendance practice.
Unless expressly stated otherwise, Portal content is general information and professional-support material. It is not individual legal, medical, clinical, financial or safeguarding advice.
Attendance decisions can involve education law, safeguarding, SEND, equality duties, health, social care and individual family circumstances. Appropriate professional judgement must therefore always be applied.
Guidance and legislation differ across England, Scotland, Wales and Northern Ireland and may change over time. Users remain responsible for checking the current rules relevant to their jurisdiction and circumstances.
Portal tools should support professional judgement rather than replace it.
13. Availability and changes to the Portal
We aim to keep the Portal available and its resources useful, but we cannot promise uninterrupted or error-free access at all times.
Temporary interruption may occur because of maintenance, security incidents, service-provider issues or circumstances outside our reasonable control.
We may make reasonable changes to the Portal to:
- improve content or functionality;
- respond to changes in law or guidance;
- protect security;
- replace outdated resources;
- address technical issues;
- develop the membership offer.
Where a change materially reduces a paid service during a current membership period, we will consider the impact on affected members and any rights or remedies required by law.
14. Responsibility and liability
What we do not exclude
Nothing in these Terms excludes or limits responsibility where it would be unlawful to do so.
In particular, nothing excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot lawfully be excluded.
If you are a consumer
We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to the law.
We are not responsible for business losses suffered by someone using the Portal wholly or mainly for personal consumer purposes.
If you use the Portal for business purposes
Subject to liabilities that cannot lawfully be excluded, we will not normally be responsible for indirect or consequential business losses such as loss of profit, revenue, anticipated savings, goodwill or business opportunity where those losses were not reasonably contemplated as part of the relevant agreement.
Nothing in these Terms makes us responsible for decisions made independently by a school, trust, professional, parent, local authority or other organisation simply because a Portal resource was consulted.
15. Suspension or termination of access
We may take proportionate action where there is evidence of a serious or repeated breach of these Terms.
Depending on the circumstances, this may include contacting the account holder, restricting particular activity, temporarily suspending access or terminating access.
Where practicable, we will explain the issue and provide a reasonable opportunity to resolve it before terminating paid access.
Immediate restriction may be necessary where we reasonably believe there is fraud, unauthorised account use, a serious security threat, unlawful activity or a risk to other users.
Any action we take will remain subject to applicable consumer rights and other legal obligations.
16. Complaints and resolving problems
If something has gone wrong, please contact us so that we have an opportunity to investigate and resolve the issue.
When contacting us, please provide enough information to identify the relevant account, purchase or resource and explain the problem you would like us to consider.
17. Governing law
These Terms are governed by the law of England and Wales, subject to any mandatory rights that apply to you under the law of another part of the United Kingdom or another jurisdiction.
If you are a consumer living in Scotland, Northern Ireland or elsewhere, nothing in these Terms removes any right you have to rely on mandatory local consumer protection or to bring proceedings in a court available to you under applicable law.
For business-to-business arrangements, the courts of England and Wales will have jurisdiction unless we have agreed otherwise in writing.
18. Changes to these Terms
We may update these Terms when our services change or where an update is reasonably required because of legal, regulatory, security or operational developments.
The latest version will be published on this page with its effective date.
We will not use a change to these Terms simply to remove rights already accrued under an existing paid contract where doing so would be unlawful or unfair.
Where a material change affects an ongoing paid membership, we will take reasonable steps to bring it to the attention of affected members where appropriate.
